1. Using the Services
We give you a personal, non-exclusive, non-transferable licence to use each Service on devices you own or control, for your own non-commercial use, in line with these terms and the rules of the store you got it from (such as the Google Play Terms of Service).
You must not copy, resell, reverse engineer or modify a Service except where the law allows it, try to get around any purchase or security feature, or use a Service in a way that breaks the law or harms other people, us, or the systems the Service relies on.
2. Messaging and user content (Relay and Beep)
Relay and Beep let you send messages to other people. You are responsible for what you send. You must not use them to:
- harass, threaten, abuse or impersonate anyone;
- send spam, malware, or illegal, sexually exploitative or hateful content;
- share content you don't have the right to share.
Messages may be end-to-end encrypted or relayed through third-party servers, so we usually can't see, moderate or recover them. Where a Service offers blocking or reporting, please use it, and contact us about serious misuse. We may restrict access to a Service for anyone who breaks these rules, where we are able to.
You keep ownership of what you send. You let us transmit and store it only as needed to deliver it and run the Service.
3. Purchases
Some Services are free, and some offer paid content, such as the one-time full-game unlock in Suki: Night Glide. Prices are shown before you buy.
- On Google Play, purchases are processed by Google under Google Play's terms and refund policies.
- On the web, purchases are processed by Stripe. After buying Suki: Night Glide on the web you get a restore code that unlocks the full game on up to 5 devices. Keep it safe and don't share it publicly.
Purchases unlock content for your personal use; they don't transfer ownership of the Service.
4. Refunds and your consumer rights
Our Services come with guarantees that cannot be excluded under the Australian Consumer Law. You may also have rights under the consumer laws of the country you live in, including the European Union. Nothing in these terms limits those rights.
If a paid feature doesn't work as described, email us and we'll fix it, restore your purchase, or refund you. For Google Play purchases you can also request a refund through Google Play.
5. Privacy
Each Service's privacy policy explains what information it uses and why. You'll find it on its Google Play listing and website, for example the Suki: Night Glide privacy policy.
6. Our content
The Services, including their code, artwork, music, characters and names, belong to us or our licensors and are protected by copyright and other laws. Open-source parts are covered by their own licences.
7. Availability and changes
We work to keep the Services running and up to date, but we can't promise they will always be available or free of errors. We may update, change or stop a Service. If we stop selling or supporting paid content you bought, we'll treat you fairly and in line with your consumer rights.
8. Third-party services
Some Services rely on others, such as Google Play, Stripe, our web host, or messaging servers. Their own terms apply to your use of them, and we aren't responsible for services we don't control.
9. Liability
To the extent the law allows, and apart from the guarantees in section 4, the Services are provided "as is", and we are not liable for indirect or consequential loss, or for loss of data or messages. Where our liability can be limited but not excluded, it is limited to supplying the Service again or refunding what you paid for it. Nothing here limits liability that cannot be limited by law.
10. Ending these terms
You can stop using a Service at any time by uninstalling it or leaving the website. We may suspend your access if you seriously or repeatedly break these terms.
11. Changes to these terms
We may update these terms. We'll post the new version on this page and change the date at the top. If you keep using a Service after that, the updated terms apply.
12. Governing law
These terms are governed by the laws of Australia. If you are a consumer living elsewhere, you also keep any protection given by the mandatory laws of your country, and you can bring a claim in your local courts.
